Footpath Trading Review – Have Your Say

What works?  What doesn’t? How can we improve Footpath Trading in Port Phillip?

We are currently reviewing our Footpath Trading Guidelines and we’d be interested in your views and feedback. These guidelines are fundamental to managing the Port Phillip footpath and outdoor dining experience.

Please Note: Public Consultation regarding Footpath Trading Guidelines closed on Wednesday 1 July. For further information, please contact Manager Economic Development & Tourism - 03 9209 6593.

The review of Footpath Trading Guidelines has been established to ‘check-in’ with local businesses, residents, visitors and council and will explore opportunities to improve the current Footpath Trading service for all users.

The review of the guidelines will consider issues including;
·        Compliance with all relevant legislation
·        The maintenance of a clear pedestrian zone along the building line
·        Hours of operation on the footpath
·        Safety and suitability of furniture on the footpath
·        Outdoor furniture styles
·        Management responsibilities (both council and trader)
·        The amount of furniture permitted within a designated area
·        Standard setbacks from existing street furniture and nearby parking

The review will include a risk assessment against relevant legislation including the Local Government Act, the Disability Discrimination Act and relevant liquor licence and outdoor smoking controls.

Current Footpath Trading Guidelines & Management Standards

Currently the Footpath Trading Guidelines 2005 is the document used by council to manage footpath trading in the municipality. It is this document which is under review.

These existing Guidelines were developed by the council in consultation with the local business community to provide a framework for the sustainable use and management of our footpath trading areas. They are designed to ensure that pedestrians have unobstructed and safe access to our footpaths at all times, while maintaining the visual amenity of our streetscapes. It is important to acknowledge that the commercial use of public space is a privilege, not a right and the City of Port Phillip is committed to supporting and enhancing the sustainable growth of local business and vibrant street life activity.

These management standards often get challenged by all users of the street.  These have been outlined to prompt your thoughts for giving feedback.
